1. Overview

This website is operated by TideSip, based in San Diego, California ("we," "us," "our"). By visiting the site or buying from us, you agree to these Terms of Service ("Terms") and to the policies linked here, including our Refund Policy, Shipping Policy, and Privacy Policy. If you don't agree, please don't use the site.

We may update these Terms from time to time. Changes take effect when they're posted on this page. If you keep using the site after a change, you accept the updated Terms.

2. Eligibility

You must be at least 18 years old and able to enter into a binding contract to place an order. We ship within the United States only.

3. Important product information

Products sold by TideSip are pet water fountains intended for household use. Nothing on this site is veterinary advice, and it is not a substitute for advice from a veterinarian. Please consult your veterinarian with any questions about your pet's hydration or health.

4. Setup, use, and care

• Follow the product's included assembly, setup, use, cleaning, and filter-replacement instructions.
• Check the product before each use. Stop using it if any part is loose, damaged, leaking, or not working as described, and contact us.
• Do not modify the product or use it for anything other than its intended purpose.
• Keep cords and electrical components away from water except as directed in the instructions, and supervise pets that chew cords.

Whoever buys, sets up, or supervises use of a product is responsible for making sure it's suitable for their pet and the space where it will be used.

5. Products, descriptions, and pricing

We try to describe and photograph products accurately, but colors, finishes, and minor details may vary. Product specifications come from our suppliers. Prices and availability can change without notice. If a product is listed at an incorrect price or with incorrect information because of an error, we may cancel any order for it and refund you in full.

6. Orders and payment

Placing an order is an offer to buy. We may accept or decline it, including limiting quantities or canceling orders that look fraudulent or that we can't fulfill. If we cancel an order after you've been charged, we'll refund you in full. Payments are handled by third-party payment processors, and we do not store full card numbers. You agree to provide accurate, current purchase and account information.

7. Shipping, returns, and refunds

Shipping is covered by our Shipping Policy. Returns and refunds are covered by our Refund Policy, which provides a 30-day return window.

8. Intellectual property

The site and its content, including text, graphics, logos, images, and video, belong to TideSip or its licensors. You may not copy, reproduce, or reuse them for commercial purposes without our written permission.

9. Acceptable use

You agree not to use the site for anything unlawful, to interfere with its operation or security, to upload malicious code, to scrape or collect data from it without permission, or to impersonate anyone.

10. Reviews and comments

If you submit a review, comment, or other content, you confirm it's truthful and yours to share, and you give us a non-exclusive, royalty-free right to display and use it in connection with the site and our products. We may remove content that's unlawful, offensive, or misleading. Reviews reflect individual experiences.

11. Third-party services and links

The site runs on Shopify and uses other third-party services, such as payment processors and email providers. We aren't responsible for third-party websites or services, and your use of them is governed by their own terms.

12. Disclaimer of warranties

Except as expressly stated in these Terms or our Refund Policy, and to the fullest extent permitted by law, the site and all products are provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Any manufacturer warranty that comes with a product applies as stated by the manufacturer. Nothing in these Terms limits any rights you have under applicable consumer protection law that cannot be waived.

13. Limitation of liability

To the fullest extent permitted by law, TideSip will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the site or products, including damages resulting from failure to follow a product's instructions. Our total liability for any claim relating to a product will not exceed the amount you paid for that product. Some jurisdictions don't allow certain limitations, so some of these may not apply to you.

14. Indemnification

You agree to indemnify and hold harmless TideSip from claims, losses, and expenses, including reasonable attorneys' fees, arising from your breach of these Terms or your misuse of the site or products, to the extent permitted by law.

15. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in San Diego County, California, unless applicable law requires otherwise.

16. Severability and entire agreement

If any part of these Terms is found unenforceable, the rest stays in effect. These Terms and the policies they reference are the entire agreement between you and us about the site and your purchases.
